Maximizing Your Chances of Successful Service of Process in Ohio

Sample of attempt documentation in service of process.

Process serving is a critical aspect of the legal system, and it involves delivering court documents to the respondent. As a matter of practice with process serving in the State of Ohio, we will make multiple attempts to serve the respondent with the legal documents with complete documentation of our attempts. This is vital in case perfected service is challenged, or alternative service methods need to be utilized. RVB Services, LLC is a company that specializes in process serving in Ohio, and we take great care to ensure that we complete service of process in a professional and efficient manner documenting all of our due diligence so there is never a question of our attempts.

RVB Services, LLC understands the importance of documenting due diligence in process serving, and we make multiple attempts to serve the respondent. Our process servers make attempts in the morning between 7 and 10 am, in the evening between 6 and 9 pm, and on weekends to increase the chances of serving the respondent. We go one step further by giving a fourth attempt to ensure that all bases are covered. Our goal is to serve the respondent with the legal documents as soon as possible. If that is not possible, we get you documentation for alternative forms of service.

In addition to making multiple attempts, our process servers take pictures of the address, cars on site, the house, we note if lights are on, if mail can be seen in the mail box, if trash is on the curb, and various other occupancy indicators to document our due diligence efforts. Our attempt logs include photos with the date and time stamp on the picture down to the second, GPS coordinates, and street, city, zip code, and county information stamped on the picture with a Google Map overlay pinpointing our location. This information is crucial in establishing that we made diligent attempts to serve the respondent, and whether or not they are attempting to avoid service.

In addition to physical attempts, we also use yellow call back cards to facilitate the process which we leave behind after the 2nd or 3rd attempt. These cards include the name of the person we are trying to reach, the date and time we were there, and our file number. The card notes that we have a delivery that requires personal acknowledgement and includes a phone number to call to arrange delivery. Taking a picture of the call back card helps to document our due diligence efforts and ensures that we have a record of our attempts to serve the respondent and giving them every opportunity to respond.

If conventional methods of service are not successful, alternative service methods can be utilized with court approval. These methods could include service by publication, posting the documents to the door, or regular U.S. mail. Our detailed documentation methods is one way RVB Services, LLC makes the most impact to assist clients in obtaining court approval for alternative service, if we are not able to obtain service, or if a respondent is actively avoiding.

It is important to note that when a process server makes multiple attempts and is unable to serve the respondent, it is imperative that due diligence is thoroughly documented. This documentation should include details of the attempts made, conversations with people inside the home, neighbors, postal carriers, and apartment managers if applicable to name a few. We obtain any information we can to perfect service of process, or to to find credible information on why it is not reasonable to expect service of process at an address. For example, the respondent may have moved, passed away, is incarcerated, or left the job. In such instances, the due diligence makes the record so alternative service methods can be requested with the Court.

RVB Services, LLC is committed to completing service of process in Ohio with due diligence and professionalism. We make multiple attempts to serve the respondent, take pictures of the address and occupancy indicators, and document our due diligence efforts so you can proceed with your court case. If conventional methods of service are not successful, we assist clients in obtaining court approval for alternative service methods with our detailed return of service affidavits. At RVB Services, LLC, we understand the importance of process serving, and we strive to make the process as efficient and effective as possible.
